The Health and Safety Executive have confirmed that whilst their emphasis is on prevention, they will come down hard on those that put others at risk, particularly when they deliberately flout the law.

 

The Corporate Manslaughter and Corporate Homicide Act 2007 came into force on 6th April 2008 and for the first time, companies and organisations can be found guilty of corporate manslaughter as a result of serious management failures resulting in a gross breach of a duty of care.

In 2006/7, the number of offences prosecuted by the HSE increased to 1141 from 1056 in 2005/6.  The number of convictions increased in 2006/7 to 848 and the average penalty per conviction in 2006/7 was £15,370.
